Transit Visa for International Travel with a Foreign Destination

Prior to August 2003, foreign nationals had options for traveling through the United States on their way to a foreign destination under the Travel Without a Visa (TWOV) Program or the International-To-International (ITI) Program. However, these programs have been suspended indefinitely. If you are a foreign traveler making a stop in the United States-even for an airline layover for a few hours-you must now obtain a C-1 transit visa.

However, not all individuals stopping in the United States will have to apply for and obtain a C-class visa. Countries that participate in the Visa Waiver Program with the United States may pass through the United States with only a machine-readable passport.

An immigration lawyer can tell you more about the C transit visa, and help you with application for and renewal of your C visa.

Who Qualifies for a C Transit Visa?

A transit visa is issued to foreign nationals proceeding in immediate and continuous transit through the U.S. to a foreign destination. Once approved and having entered the U.S., these visitors are allowed to move freely for the period of time allowed on their transit visa. However, the immigration officer must be satisfied that the transit journey will not be interrupted before the C visa is issued.

Visa Application process

Visa Application and Interview

Transit visas may be obtained at any American embassy or consulate. Anyone wishing to visit the United States under a temporary, nonimmigrant visa status, including visitors passing through the United States in transit, must submit Form DS-156, the "Nonimmigrant Visa Application form." Additionally, some individuals, including all male applicants between 16-45 and those coming from North Korea, Cuba, Syria, Sudan, and Iran (known as "state sponsors of terrorism"), will also be required to complete a Supplement Nonimmigrant Visa Application, Form DS-157.

As outlined above, you will need to provide documentation showing that your trip will not result in a permanent stay such a plane ticket or itinerary as well as proof that you have enough funds to cover expenses during your trip in the United States. Prepare so that you are able to show documents of this kind if you are asked.

Visa Application Fees

On January 1, 2008, the Department of State raised the fees for visa services. The current application fee for a visa is $131, and if you are approved and issued a visa, you will also have to pay a "visa issuance fee" of $131. However, some countries with visa reciprocity (including many in the Visa Waiver Program) do not require a visa issuance fee. Check the Department of State website for more.

My Family is Traveling through the U.S.-Do All Family Members Have to Obtain a C Visa?

C-class visas are for individuals. Thus, any person who wishes to enter the United States must apply for and obtain a C visa, including each member of your family.

Can I Receive a Time Extension to Stay Longer with my C Visa?

Because the transit visa is issued for a predetermined period of time with a specific purpose in mind, no time extensions may be granted.
